Beyond Compensation: Transformative Reparations and the Mapuche’s Struggle for Systemic Reform in Chile
Abstract/Contents
- Abstract
- This paper explores the concept of transformative reparations as a means of improving transitional justice. Transformative reparations move transitional justice beyond surface level solutions by reforming the structural causes that made victims vulnerable to oppression in the first place, ensuring non-repetition. Despite challenges with implementation, transformative reparations empower civil society and offer a path to lasting structural reform. Using Chile as a case study, the paper delves into the efforts of Mapuche organizations like Aukiñ Wallmapu Ngulam and Wallmapuwen, advocating for transformative reforms such as land restitution and political autonomy. In the pursuit of upholding human rights for vulnerable populations, transformative reparations stand as a vital avenue for societal transformation that extend beyond compensation.
