Abstract
In the context of increased displacement across the globe and within the Americas, this study focuses on Venezuelan immigration to Colombia, with migrants from Venezuela constituting the second-most displaced population in the world. Colombia has received the most Venezuelans in the world, constituting approximately 2.5 million people, and has implemented one of the most robust regularization schemes in the region. This is exemplified by the Estatuto Temporal de Protección para Migrantes Venezolanos (ETPV), and subsequent Permiso de Protección Temporal (PPT), which give people within the scheme up to 10 years to obtain permanent legal residence in the country. Although welcoming, comprehensive, accessible, and massive (up to 1.6 million Venezuelans have been accepted within the scheme), the ETPV and PPT continue to subject migrants in Colombia to violent interactions in different instances in society, such as when engaging with government institutions or looking for employment. This work is based on in-depth semi-structured interviews conducted in Bogotá, Colombia, during the months of July and August 2023, using a qualitative approach to argue that although Colombia’s scheme is an improvement and even essential measure, this exists in conjunction with persisting violent dynamics around the process of obtaining and using the PPT daily in Colombia, leading to exclusion, anger, and frustration. Analyzing this through a sociology of law lens, this work argues that the type of experience Venezuelans have with the PPT in Colombia, partly due to its perceived progressiveness and accessibility, constitutes another layer of legal violence with a more subtle undertone.
